Two conflicting court decisions have left Canada without a settled answer on whether Aboriginal title can apply to privately owned land. A B.C. ruling recognized coexistence of Aboriginal title with private ownership in the Cowichan case, while a New Brunswick decision held that a court cannot issue a declaration of exclusive possession against private owners. The Supreme Court of Canada has so far declined to resolve the split.
